By submitting this form requesting services at the indicated property from Canyon County via Weed and Pest Control Department, I hereby acknowledge that I understand and agree to the following, as well as all written waivers required by the County that I may sign at the time services are rendered:
1. I have the authority to request and permit Canyon County to provide weed control and pest abatement services at the location indicated in this form (hereafter referred to as “requested services” and includes any services actually performed by Canyon County Weed & Pest Control not indicated in this form).
2. The requested services and supplies are not free. I will be responsible for costs of materials and services connected to the requested services for which I have to pay the County. Any refund is at the sole discretion of Canyon County.
3. It is my responsibility to ensure that work areas are clear of debris or areas that may pose hazards to equipment are visibly flagged or marked and the Canyon County employees are aware of its location. The appointment for requested services may need rescheduled depending on staffing availability, weather, or environmental circumstance, or other factors outside the control of Canyon County.
4. There is no guarantee of results. I am aware that gopher traps and other reduction methods may not eliminate all gophers on my property and may not lead to permanent eradication. I am aware there will also be no guarantees as to the level of success of the barn owl nest, except that it will be installed correctly and safely. I will hold harmless Canyon County and its employees should any damage of any kind, directly or indirectly, occur to any areas of my property. I understand that Canyon County and its employees are not liable for any form of injury which may arise as a result of installing and using the barn owl nest. I am aware there are many known and unknown dangers
and / or risks associated with the install and use of the barn owl nest. The application of herbicide may not achieve total weed elimination or control on a temporary or permanent basis, even when applied pursuant to label instructions. I am aware that the application of herbicide may have negative consequences on nearby vegetation that are unpredictable, unforeseeable, and outside the control of Canyon County, including migration of herbicidal chemicals via surface water or other conditions, such as weather. I understand that Canyon County is not responsible for any such damages.
5. The Idaho Torts Claim Act, Title 6, chapter 9 of the Idaho Code, limits the liability of Canyon County for any damages resulting from the requested services. I agree to release and waive all claims against the County, its agents, and employees arising out of or related to the requested services. This release and waiver includes, without limitation, claims for bodily injury, property damage, and loss of use and any consequential damages or attorney fees. I agree to hold harmless and indemnify Canyon County for all damage claims from third-parties arising out of or related to the requested services including costs of defense for any investigations, fees, fines, or orders by state or federal agencies.
